What about the children or parenting orders?

A child under the provisions of the Family Law Act 1975 is one who is under the age of 18 years.

The parties are encouraged to settle disputes concerning the children before proceeding to Court and to this end there is a pre-dispute resolution process requiring the parties to attend Mediation.

Mediation is usually conducted by the Family Relationship Centre, Unifam, Relationships Australia, CatholicCare or Interrelate.

Section 60(cc) of the Family Law Act 1975 lists a number of factors which the Court takes into account when making parenting orders.
