COVID-19 and Family Court in NSW

Chief Justice Alstegren has released an update to assist families and their advisors on 26 March 2020. He confirms that parents must comply with parenting orders. However, he also gives us a pathway to navigate the changing times so that the best interests of the children and their relationship with each parent can be maintained.

Among the points he makes:

  • As there may be vulnerable grandparents who would normally manage changeovers, alternative arrangements may be made as agreed between the parents.

  • Where contact centres are closed, consideration may be given for changeovers at public places.

  • It remains up to the Courts to decide whether a parent has contravened an order and whether there has been a reasonable excuse.

  • Parents should always remember that the health and safety of our children and their families is extremely important and to work together to resolve problems rather than create them.

  • The coronavirus should not be used as an excuse for non-compliance with parenting orders.

  • If it is a risk to the children because of the pandemic for them to travel or because they are self-isolating with a family member, then SKYPE, FaceTime and telephone communication should be considered as an alternative so that the children can maintain a meaningful relationship with both parents.

This is a very stressful time for all family members especially when so many parents and partners are working from home in a confined space that puts unimagined stresses on normally settled and happy relationships. If you are experiencing any difficulties Relationships Australia has some useful counselling, the ABC has a mindfulness APP and Lifeline, Beyond Blue and Kids Helpline are there to help you.

If you need immediate assistance please contact us and we will get back to you as soon as possible.

This is an evolving situation and updates will be made by the Courts on a continuing basis.
